Should I Use 1099's for my Landscaping Workers?

Hello all!

 

I own a Landscaping company and was wondering if I could just get some opinions/advice on 1099's. Is it better to put my employees (5) on a regular payroll, where taxes are taken out and a check is drafted up  or  should I issue 1099's at the end of the month, 3 month, 6 month or yearly and have them be incharge of their taxes.

It all depends on whether they are employees or independent contractors. If they are employees, they should be on regular payroll and have taxes withheld. But if they are independent contractors, then you would issue them a 1099 at the end of the year and they would handle the taxes. If you aren't wanting to worry about filing the payroll taxes and taking care of it all, I would recommend using Full Service Payroll. All you would need to do is run the payroll and they take care of the rest. Hope this helps!!

And it is not your decision to make, they either qualify as independent contractors or they do not and then must be on payroll, see the attachment.

 

1099's are year end forms only, if they are contractors

Perhaps this article (https://www.learnvest.com/knowledge-center/the-difference-between-a-1099-and-a-w-2/) would assist you in determining if an individual is a 1099 or a W2. Control, control, control....

I took your interview, I answered that yes I supply all tools and materials

And it said the worker was a 1099 contractor
