Can an employee contribute to a non employer sponsored HSA ? I have an employee who would like to have their HSA contributions taken out of their paycheck. The HSA is through their private insurance and not employer sponsored.

You cannot withhold money from their paycheck and deposit it into their personal HSA - certainly not pre-tax and not even after-tax.  The employee needs to make the contributions to their personal HSA after tax and they can deduct those contributions (up to the allowable limit) on their personal tax return as long as their health insurance plan is HSA-eligible.
