I have a client - who has no more employees on the payroll. But the business is STILL OPERATING.

When do we issue W2 if the business has NOT closed?

Can you provide any link to IRS that talks about this - all I can find is "when closing a business" - that is not this case.

Let me share some information about the due dates.

If a business is still operating, employers are encouraged to file Forms W-2 by the following due dates:

January 27, 2021

E-file your W-2 forms with the Social Security Administration
E-file your W-2 forms with your state. State lead times may vary.

February 1, 2021

Send W-2s to your employees.
File your form 1099-NEC and 1096.
Review and file federal forms, such as Forms 941/944 or 940.
File state forms (form names and due dates vary by state).
Invite employees to access pay stubs, W-2s, and timesheets.
