Question

Quickbooks Time, IR35 & CIS Subcontractors.

Hi

We have recently started to use Quickbooks Time for our construction business.

One of our CIS Subcontractors is refusing to use it as he says he believes it would put him inside IR35 legislation. I don't believe this, I think he's just not wanting to play ball as he won't be able to swing the lead as much.

Can anyone confirm if this is the case, or give me a suitable reply please?

Hello Teebeebooks, Welcome to the Community! Can we ask what part of Quickbooks Time the subcontractor feels would put them inside IR35, is this something that they feel does not show as reasonable care within HMRC guidelines? If we have specifics we can provide a full answer in regards to the legislation.

Hello

Just the general use of it. No specific area, just that he feels by us knowing where he is at all times makes him fall into IR35.

Thanks TeeBeeBooks, the location tracking can be disabled on the app, so that the worker only records the start and end times of their shift for timesheet purposes - we'd recommend referring to this site or contacting HMRC or and accounting professional for further guidance on IR35 regulations. 🙂
